I recently returned from making a presentation on Ethics in Workers’ Compensation at the Workers’ Injury Law and Advocacy Group (WILG) National Conference in Santa Barbara, California.  Over 200 attorneys attended, representing injured workers in all 50 states.  I have been making these ethics presentations for over 20 years to national audiences.  Among the latest issues discussed were:

  • When does a caller become a client subject to conflict/confidentiality rules?
  • How much information must the client have to be able to give “informed consent” to the lawyer’s course of action?
  • What kinds of claims are covered in a Retainer Agreement?
  • May a lawyer omit certain details of a worker’s claim to an opposing attorney?
