“In [repetitive lifting and occupational disease] cases, injured workers regularly claim that the ongoing occupational exposure experienced over the course of employment caused the disability, thus triggering the date of injury as the last day of employment. For an occupational back injury, the work exposure need not be the sole cause but only a material, contributory causative factor in the onset or progression of the back disease.” – Tom Domer, “Wisconsin Workers’ Compensation Experts”
Injuries Due To Occupational Exposure And Repetitive Stress
Diseases or repetitive stress injuries are “occupational” when they are acquired over a period of time, not as the result of one specific traumatic event. A “work-related condition” is something that develops from the work you do only as part of your job, such as heavy lifting, repetitively twisting or bending or exposure to harmful chemicals. Under Wisconsin law, there is no minimum period of exposure or time at work before a condition can be considered an occupational disease. The law only requires that the exposure or job duties be a material contributory causative factor in the onset or progression of the condition. As little as a 5% contribution can be sufficient, so workers are well-advised to call an attorney if they feel their job duties contributed to a medical condition.
If you suspect that you have a condition that occurred because of the long-term conditions of your employment, the experienced attorneys at
